Restorize Terms of Service

These Terms of Service ("Terms") govern your use of Restorize, a project management tool for Restoration Companies, provided by Industrial Software Group ("ISG"). By accessing or using Restorize, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference into these Terms. If you do not agree to these Terms, please do not use Restorize.

1. Description of Service

Restorize is a project management tool designed for Restoration Companies to manage their projects efficiently. The service includes features such as task management, communication tools, file sharing, reporting, and more.

2. User Accounts

a. To access Restorize, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

b. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

c. ISG reserves the right to suspend or terminate your account and refuse any and all current or future use of Restorize for any reason at any time.

3. Use of Restorize

a. You may use Restorize only for lawful purposes and in accordance with these Terms. You agree not to use Restorize:

In any way that violates any applicable law or regulation.
To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," or "spam" or any other similar solicitation.
To impersonate or attempt to impersonate ISG, an ISG employee, another user, or any other person or entity.
To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of Restorize, or which, as determined by ISG, may harm ISG or users of Restorize or expose them to liability.

b. You are solely responsible for your interactions with other users of Restorize. ISG reserves the right, but has no obligation, to monitor disputes between you and other users.

c. ISG may update or modify Restorize at any time without prior notice.

4. Intellectual Property

a. Restorize, including its software, design, and content, is protected by copyright, trademark, and other laws of Australia and other countries. You agree not to remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying Restorize.

b. All trademarks, service marks, logos, trade names, and any other proprietary designations of ISG used herein are trademarks or registered trademarks of ISG or its affiliates.

5. Privacy

ISG's Privacy Policy governs the collection, use, and disclosure of your personal information. By using Restorize, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

6. Limitation of Liability

In no event shall ISG, its officers, directors, employees, or agents be liable to you or any third party for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit damages arising from your use of Restorize.

7. Indemnification

You agree to defend, indemnify, and hold harmless ISG, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of Restorize.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

9. Changes to Terms

ISG reserves the right to update or modify these Terms at any time without prior notice. Your continued use of Restorize after any such changes constitutes your acceptance of the new Terms.
